I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN ANY MARS PHILIPPINE AIRCRAFT ACTIVITIES, INCLUDING AIRCRAFT TOURS, TANKER BASE TOURS OR WATER TAXI RIDES ASSOCIATED WITH THE OWNER: Arizona Aerospace Foundation (AFF) or OPERATOR: COULSON AIRCRANE LTD (Coulson), COLLECTIVELY KNOWN AS THE OWNER/OPERATOR, including by way of example and no limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective vehicles or equipment, or property owned, maintained, or controlled by them, or because of their possible liability without fault.

I acknowledge that this Accident Waiver, Media Release, and Release of Liability Form will be used by the Owner/Operator in any Touring or Water Taxi related activities in which I may participate, and that it will govern my actions and responsibilities at said activity. I also acknowledge and agree that I may be photographed, video taped or involved in a media event, whether knowingly or unknowingly.

In consideration of my application and permitting me to participate in any Owner/Operator activity, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:

(A) I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from any Owner/Operator activity;

(B) I GRANT to the Owner/Operator, and its representatives, agents, and assigns, the irrevocable and unrestricted right to photograph and videotape my attendance at the location and any activities in which I participate, and to use and publish the resulting images and videos for any purpose, including but not limited to advertising, promotion, and marketing, in any and all media, whether now known or hereafter existing, controlled by the Owner/Operator, in perpetuity

(B) INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities mentioned in this paragraph from any and all liabilities or claims made as a result of participation in any Owner/Operator activity, whether caused by the negligence of release or otherwise.

I acknowledge that the Owner/Operator and their respective directors, officers, volunteers, representatives, and agents are not responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific activity on their behalf.

I release and discharge the Owner/Operator and its representatives, agents, employees, and assigns from any and all claims and demands that may arise out of or in connection with the use of the photographs or videos of myself or a likeness of myself, including but not limited to any claims for defamation, invasion of privacy, or rights of publicity.

I acknowledge that any Owner/Operator activity carries with it the potential for death, serious injury, and property loss. The risks include, but are not limited to, those caused by vehicles, aircraft, boats, equipment, facilities, temperature, weather, condition of participants, lack of hydration, and actions of any employee, contractor, or volunteer of the Owner/Operator.

I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during any Owner/Operator activity.

The Accident Waiver, Media Release, and Release of Liability Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
